A TRANSGENDER woman who sued beauticians for refusing to wax her testicles has lost her human rights lawsuit.
Jessica Yaniv, 32, complained she had been refused ‘Brazilian’ waxing services at more than a dozen salons in Canada since 2018.

She brought legal proceedings against five home-based female estheticians – waxing experts – who would not perform the treatment on her scrotum.
Yaniv is a male to female transgender woman who has not yet had sex-reassignment surgery, which means she has male genitalia.
She claimed the women were discriminating against her “based on gender identity and gender expression”.
Yaniv filed various complaints against estheticians in Vancouver area, causing one to go out of business as she was seeking as much as $15,000 in damages from each beautician.
The female beauticians argued they were not trained to perform a ‘Brazilian’ on male genitalia and could have caused serious injury to the customer.

Some of the beauticians argued they should not be forced to touch male genitals if they don’t want to and others cited religious reasons.
The human rights tribunal ruled in favour of the beauticians, who come from diverse ethnic backgrounds.
The verdict stated: “Human rights legislation does not require a service provider to wax a type of genitals they are not trained for and have not consented to wax.”
The decision also found Yaniv “engaged in improper conduct” and “filed complaints for improper purposes”.
Human Rights Tribunal member Devyn Cousineau wrote: “The most likely scenario is that Ms Yaniv was trying to make (the esthetician) feel uncomfortable or awkward for her own amusement, or as a form of revenge.”
The ruling added that Yaniv had deliberately targeted small businesses for “personal financial gain”.

“In many of these complaints, she is also motivated to punish racialized and immigrant women based on her perception that certain ethnic groups … are ‘taking over’ and advancing an agenda hostile to the interests of LGBTQ+ people.”
The tribunal ordered Yaniv to pay $2,000 to each of the three estheticians represented.
